Terms & Conditions
The following terms and conditions constitute the "agreement" between Buy A Bounce. (BAB) and the Customer (Bill To) as stated. on the invoice. Read before signing.
1. DEPOSIT: A 20% deposit based on the dollar value of the entire order must be received by BAB no later than 5 calendar days from invoice date; otherwise the order will not be processed, and will be canceled automatically without further notice. Deposits and final balance must be made in US funds in the form of a personal or company check, bank check, cashiers check, money order, cash, wire transfer or any of the following credit cards: Visa, Master Card and Discover. For final balance however, the order will not be shipped until check has cleared. All ‘will call’ orders and orders with a CA ship to destination are subject to CA sales tax unless recipient has a valid CA Seller’s Permit. Custom and printed sign banner orders require a 100% payment prior to invoicing.
2. CANCELLATION AND RE-STOCKING FEES: All sales are final unless otherwise agreed to in writing. All cancellation for non made-to-order and custom orders will be subject to a cancellation fee equal to 15% of the purchase value of the unit being cancelled. If the balance of an order is not paid 30 days from the estimated shipping date, the order will be automatically cancelled and will be subject to a re-stocking fee equal to 15% of the purchase value. Delivery dates are not guaranteed and are not grounds for cancellations. All made-to-order and custom orders require full payment prior to invoicing. Cancellation, within 15 days from the invoice date will result in a cancellation fee equal to 10% of the purchase value. All cancellations must be in writing. Cancellation AFTER 15 days from the invoice date will result in forfeiture of the entire invoice amount.
3. SHIPPING: Our prices are F.O.B. Los Angeles, CA or F.O.B Eagan, MN.BAB will not be responsible for freight charges or transit times over what may have been quoted prior to shipment. The carrier is specified by BAB and is chosen by best rates and quickest transit time. The carrier choice is always reviewed with the customer and/or at the customer's request. The customer must inspect the package(s) for damage(s) before signing the Bill of Lading. Any and all claims for any shortage of product must be reported to BAB within five (5) working days from receipt of shipment. Customer should refuse the shipment if there are items missing or there is damage on the package, or should make a note on the Bill of Lading for further claim evaluation.
4. WARRANTY: Customer shall inspect the product promptly after receipt. Any and all claims for any defective product must be reported to BAB in writing including photos, within five (5) working days from receipt of shipment. All new inflatables are guaranteed to be free of defect for a period of one (1) year from the date of purchase. All bounce house / jump models are guaranteed to be free of defect for a period of two (2) years from the date of purchase. Any defect in the manufacturers product(s) resulting from negligence, improper usage or unusual wear and tear caused by excessive usage is excluded from manufacturers warranty coverage. The customer's usage of any inflatable product on a hard surface base (any surface other than grass), without the use of a tarp shall constitute improper usage and any resulting damage or defect shall not be covered by manufacturers warranty. Colors, artwork and design are subject to change without prior notice and will not be considered defects. Warranty repair on the inflatable products work will be provided by the manufacturer at the manufacturers’ plant. Buy A Bounce and it’s manufacturers disclaim any responsibilities for modifications and repairs from an unauthorized repair plant. Shipping cost to and from the manufacturer or authorized repair facility is to be paid by the customer. All new blowers and non-BAB manufactured products are warranted directly by the respective manufacturer. For blower trouble-shooting or warranty, please refer to the blower manufacturer manual, which is included in the blower box. All other accessories have a thirty (30) day warranty from date of shipment. No warranty is provided on misters, soaker hoses and zippers. All used inflatables and blowers are sold as is, with no warranty. Except as provided in the above agreement, BAB makes no other warranties on its products.
5. COPYRIGHT: All licensed inflatables are manufactured by Ninja Jump, Inc. and are covered by copyright and all rights reserved. Designs that are covered by patent pending are trademarks of NJI. Any unauthorized reproduction of logos, product names, trademarks, artwork, literature, photographs, and designs is strictly prohibited, constitute copyright infringement, and is punishable by law.
6. AUTHORIZED TERRITORIES: Without BAB's prior written consent, all licensed products on the invoice may only be used/rented/sold in the country that is specified on the ship to address on the invoice. Any usage, rental, or sale of licensed products to any country other than the country such licensed products have been sold and shipped to, unless with Buy A Bounce's prior written consent, is a breach of this contract and may result in legal action.
7. ACCEPTANCE: Signature by the customer and acceptance by BAB of this agreement is binding and non-cancelable unless amended upon by both parties in writing. This agreement is governed by and interpreted in accordance with the internal laws of the state of California. BAB shall not be liable for any costs or loss of income resulting from any delays. BAB recommends that the customer NOT book or rent out any inflatable unit until the unit has been delivered, received and accepted in good condition.
